Terms and Conditions

These terms govern your use of the Cigars With Care, Inc. member portal ("the portal") and your participation in the organization, including its affiliations Bro Phi Bro and Sis Phi Sis and their chapters ("we," "us"). By applying for membership, signing in or using the portal, you agree to these terms and to our Privacy Policy.

Eligibility and membership

Applicants must be at least the minimum age shown on the application and must provide accurate information. Membership is subject to approval by the organization and may be renewed, suspended or ended under these terms and the organization's bylaws and policies.

Your account

You are responsible for keeping your password confidential and for activity under your account. Tell us right away if you suspect unauthorized use. Please do not share your account or use another member's.

Dues, donations, purchases and refunds

Dues, event fees, donations and shop purchases are paid through our payment processor, Stripe; we do not store full card numbers. Amounts are shown before you pay. Unless stated otherwise, dues and event fees are non-refundable, and donations are final. Cigars With Care, Inc. is a nonprofit organization; consult your own tax advisor about deductibility. Shop orders may be refunded or exchanged at the organization's discretion; contact us promptly about problems with an order.

Automatic dues payment

If you choose to turn on automatic dues payment, you authorize us to charge your saved card the annual dues amount (less any exemption) on the renewal date each year. We email you before and after each charge. You can turn this off or change your card at any time on your profile. Your card details are held by Stripe.

Events and activities

Some events involve tobacco, alcohol or travel. You must meet all legal age requirements, participate voluntarily and responsibly, and follow venue rules. You may be asked to e-sign an annual or event waiver in the portal by typing your full name; your signature, the date and time and your IP address are recorded, and you can print your signed copy. Event details may change or be cancelled.

Community conduct

Members are expected to treat one another and our partners with respect. Harassment, discrimination, threats, misuse of member information, and conduct that harms the organization or its mission are not allowed. Chapter and national leaders may review concerns, restrict portal access, or suspend or end membership following the organization's process.

Content you share

You keep ownership of what you post (such as photos, messages and survey answers) but give us permission to use it to operate the portal and, for photos, to display them to other members. Members may be tagged in event photos. Do not post anything unlawful, misleading or that belongs to someone else. Member directory information may be used only for organization purposes, never for marketing or sale.

Member directory and communications

By joining, you agree to be listed in the member directory, to have your name, profile photo and email address shown to other signed-in members, and to be tagged in event photos. You choose whether your phone number is shown. Your chapter may celebrate your birthday (never your age) and your initiation anniversary on the portal dashboard, and we send you a greeting email on those days. Our newsletter, including the weekly summary, is optional: you can opt in or out at any time on your Profile or with the unsubscribe link in any newsletter. We always send essential messages such as account, payment, password and event-registration emails. We do not send text messages.

Mentoring, surveys, referrals and shop

Mentoring is a voluntary peer relationship and not professional advice. Survey responses help us improve. Referral recognition and awards are at the organization's discretion and may change.

Member vendors and the vendor catalog

Independent sellers. Any member may open a shop and list their own products for sale in the member shop. Listings are reviewed by leadership and appear only after they are approved; approval is not an endorsement or guarantee of the seller or product. Vendors are independent sellers. They are not employees, agents, partners or representatives of Cigars With Care, Inc. We do not own, make, inspect, store, ship, warrant or guarantee vendor products, and we are not a party to any sale between a vendor and a buyer.

Payments go directly to the vendor. Buyers pay vendors directly through the payment services the vendor chooses (Venmo, PayPal, Square or Cash App). Cigars With Care, Inc. does not process, hold, refund or guarantee these payments. Questions about an order, delivery, refunds, returns, disputes and chargebacks are between the buyer and the vendor. Pay only the amount and account shown on your order.

Sales tax is the vendor's sole responsibility. Each vendor is solely responsible for determining, collecting, reporting and paying any sales tax, use tax or other taxes that apply to the vendor's sales, and for obtaining any required licenses or permits. Cigars With Care, Inc. does not collect, report or remit sales tax on vendor sales and does not give tax advice. Vendors are encouraged to include any applicable sales tax in the listed price so that buyers know the full amount they will pay.

Vendor responsibilities. A vendor is solely responsible for the accuracy of listings, photos and prices, for the quality, safety and legality of what is sold, for compliance with all laws that apply to the products (including any age restrictions), and for delivering what was ordered. Products that are illegal, unsafe, misleading or not allowed by the organization may not be listed. We may remove any listing, or end a member's vendor access, at any time and for any reason.

Flat contribution per sale. As a condition of selling through the portal, a vendor agrees to give Cigars With Care, Inc. a flat contribution for each completed sale, in the amount shown in the vendor's shop page and set by the organization from time to time. It is a flat amount, not a percentage of the sale. It is added to the vendor's account when the vendor confirms a sale. Because a vendor receives the benefit of selling through the portal, the contribution may not be tax deductible, and vendors should ask their own tax adviser.

Buyers. Buying from a vendor is at your own risk. Review the listing and contact the vendor with questions before you pay.

Availability and acceptable use

We work to keep the portal available but do not promise uninterrupted service. Do not attempt to break, probe or overload the portal, or to access data you are not authorized to see.

Disclaimers and limits of liability

The portal and activities are provided "as is." To the fullest extent permitted by law, Cigars With Care, Inc., its officers, volunteers and chapters are not liable for indirect or consequential damages, or for harm arising from events or member interactions, except where the law does not allow that limit. Nothing here limits rights you cannot waive by law.

Ending your membership

You may leave at any time by contacting us. We may suspend or end access for violations of these terms. Sections that by nature should continue (payments owed, content permissions, disclaimers) continue after membership ends. See the Privacy Policy for how to request deletion of your data.

Changes to these terms

We may update these terms. The date above shows the latest version, and continued use after a change means you accept it.

Governing law and contact

These terms are governed by the laws of the state in which Cigars With Care, Inc. is incorporated, without regard to conflict-of-law rules. Questions: privacy@cigarswithcare.com.
